Yes. Buyer agent rebates are fully legal in Texas. Texas is one of the most rebate-friendly states in the country — there are no state restrictions on a licensed agent returning part of their commission to their buyer client. The rebate is applied as a closing credit and may require lender approval for financed purchases.
A flat fee buyer agent charges a fixed dollar amount for their services instead of a percentage of the home price. At EXL Realty Group, we charge a flat $5,000 — and any commission the seller offers above that amount may be returned to you as an estimated closing credit, subject to lender approval. On a $400,000 home with a 3% commission offered, the estimated credit could be up to $7,000.
In most cases, no. Our $5,000 flat fee is paid from the buyer agent commission the seller offers. The only upfront cost is the $300 retainer, which is credited back at closing. Any remaining commission above $5,000 may be returned as an estimated closing credit, subject to lender approval.
We’ll disclose whatever commission is offered upfront. If it’s less than $5,000, you’d cover the difference at closing. On any commission above $5,000, the surplus may be returned to you as an estimated closing credit, subject to lender approval.
It reserves your spot as an active buyer client for 60 days and covers our time during the initial search phase — scheduling, coordination, and property research.
The $300 is non-refundable if you don’t purchase a home during the agreement period. However, if you do close with us, it is credited back in full at closing — effectively making it free.
For full buyer representation, yes — a pre-approval letter is required before we begin showings. This protects your time and ours. For the $50/showing option, no pre-approval is needed.
